Florida House Democrats Urge House to Investigate New State Voting Laws

House Democrats from Florida have sent a letter to House leaders requesting hearings on the new state voting laws. The recent bill signed into law by Gov. Rick Scott imposes new restrictions on groups that register voters, requires voters to cast provisional ballots if they move to another county, and shortens the validity of voter signatures on citizen initiatives from four years to two. Opponents say that the stricter laws will disproportionately affect college students, military personnel, and low-income people.

Florida Reps. Alcee hastings, Corrine Brown, Ted Deutch, Frederica Wilson, and Kathy Castor have joined 34 other U.S. Representatives signing the letter sent to the House Committee on the Judicary. The letter reads:

"Congress has the Constitutional authority to act to protect the rights of all voters. In the face of voter suppression laws being enacted across the nation, Congress must determine the extent of the problem and provide appropriate remedies. Despite years of progress, inequities and obstacles still remain. We must work together to strengthen our nation's democracy and ensure that the voting rights of all Americans are protected. Again, we respectfully request that Committees hold a hearing to address this extremely important matter."

Sen. Bill Nelson (D-FL) also recently requested that the Senate conduct "investigative field hearings" to see if the new laws are "an orchestrated effort to disenfranchise voters" in a manner that may be illegal.

Florida House Member Lies About $30 million

In the fight for fair redistricting in Florida, while the people have voted in favor of three "Fair District" amendments, state legislatures are fighting against these amendments. Citizens were questioning why there was $30 million on reserve to deal with these redistricting battles, which would be taxpayers money basically being used to sue the taxpayers, when House Redistricting Chairman Will Weatherford denied that those funds existed. Unfortunately for him, it only takes a quick look at Transparency Florida's website to see that there are indeed funds set aside specifically to fight the redistricting amendments. Read more here.

Florida Educators fight back against Scott

It’s shaping up to be the week of class action lawsuits, as the Florida Education Association has followed the women of Wal-Mart’s lead in filing a suit against Governor Rick Scott for now requiring 3% of public workers income to go into retirement funds. The FEA is arguing that Scott’s new law is unlawful and unconstitutional as it disregards the conditions that people who signed up to work for the state government agreed on when it came to their retirement funds. Mandatory contributions from public employees’ salaries have not been a requirement in Florida, but are now being seen as necessary to compensate for budget shortfalls.

There are currently two other lawsuits on the table for Scott in regard to his controversial election reforms and the executive order to randomly drug test state employees. This class action suit will not likely be the last that Governor Scott will have to deal with in the wake of the current reforms and cuts he's making. Read more here.

Restrictive voter laws sweeping the nation

In efforts to supposedly eliminate voter fraud, there has been a large wave of legislation limiting voters' access to the polls come election day. Whether it's through voter ID laws or cutting down on early voting, many GOP-led state legislatures are passing laws that inhibit many different voting blocs from coming out to vote.

While cracking down on voter fraud is the stated motivation, there have rarely been any proven instances of it, indicating some other reason leading to these new laws. Millions of Americans don't have a government-issued photo ID; furthermore 13 million individuals don't have readily available citizenship documents. And just as percentages of early voters increase, empowered by the flexibility to vote when they have time, different laws across many states are limiting that time period.  "In Ohio, voting early on Sundays is on the chopping block and absentee voting also looks to be shaved down. In Wisconsin, Governor Walker signed a bill that drastically cut back on early voting periods and Governor Scott in Florida did the same."  In addition, there are also fights to end Election Day registration in states that have adopted it. Those states usually have 10-12% higher turnout rates than the national average.

By limiting the number of voters, conservatives is trying to cut down the effects of progressive "get out the vote" efforts, since they proved effective in 2008. Unfortunately this means the disenfranchisement of millions of voters who won't be able to have their voices heard due to these new laws across the country.

Health care for low-income families on the chopping block

Governor Rick Scott of Florida has made health services for low income women and families, such as prenatal care and family planning services, some of the items on the chopping block in respone to issues with the budget as the state tryies to cut down on state spending. However, while he's cutting these funds, controversial crisis pregnancy centers (CPCs) have not lost any of its $2 million funding since 2005.

These crisis pregnancy centers are primarily religious centers that aim to convince women not to have an abortion if they are facing that decision. Some have even been found to give inaccurate information about abortions and health care. The main focus at these centers is counseling rather than actual health care services, so instead of focusing funds on programs that do provide these services, Governor Scott is eliminating women's options for health care.

Many other states are dealing with the prospect of cutting funding for programs such as Planned Parenthood, which actually provides many services beyond abortions, and either putting the money towards programs like these crisis pregnancy centers or risking losing more money from the federal government. Indiana just passed a law to cut funding from Planned Parenthood and is now risking losing up to $4.3 billion for Medicaid. While the money for Medicaid hasn't been cut yet, the Obama administration has directed the state to drop its ban on Planned Parenthood; for now it remains a game of chicken with health care for low income families hanging in the balance.

Budget Cuts Put Important Programs on the Chopping Block

With the economy in its current state, many families must rely on food banks to keep food on the table and to keep their families going. In efforts to work within the faltering economy,conservative lawmakers are looking at cutting funding for important programs like food banks, leaving many hungry.

In places like Pittsburgh, PA where mills and plants are shutting down and leaving people without jobs, food banks become an important resource for the community. According to the Greater Pittsburgh Food Bank "children in 'food insecure' homes are twice as likely to suffer poor health and one third more likely to be hospitalized." By cutting funds to food banks, the lives of children are put at greater risk.

Other important programs such as the AIDS Drug Assistance Program in Florida may fall victim to budget cuts as well. Governor Rick Scott has proposed looking to raise the income standard for receiving medication, cutting down the largest waiting list for HIV medication in the country, but also cutting down the possibility for people with low incomes to receive treatment. Programs like these and food banks are critical for people with lower incomes, but as long as politicians refuse to look to new sources of revenue, these important programs are going to continue to be threatened by drastic budget cuts.

New Legal Measures to Help FL and WI Govs get off Scott-Free

Alongside efforts to stifle voices of reason and to destroy current campaign financing laws, conservative forces are also forcing measures that rapidly expand their power to control the philosophy of other areas of government. 

Florida Governor Rick Scott and the conservative legislature are considering measures that will split the Florida Supreme Court into two separate tribunals, one dealing with criminal proceedings and the other with civil.  If enacted this bill will allow Governor Scott to appoint three new justices, ensuring that the conservative power players in Florida's executive and legislative branches can protect their actions by creating three brand-new conservative voices on the Supreme Court.  With current efforts to cripple collective bargaining rights and force burdens onto the poor, the foresight to guarantee Supreme Court cooperation is as shrewd as it is sickening.

Unpopular Wisconsin Governor Scott Walker has likewise expanded his ability to establish new political appointees to include the legal counsels in civil service jobs.  With a Walker appointee in place, citizens' efforts to gain access to government documents will be susceptible to the whims of the Governor himself.  Like Governor Scott, Governor Walker is providing himself with future legal cover to accomplish whatever his Koch-influenced agenda dictates, in spite of his lack of public support.

It may be unfair to call these power grabs unprecedent -- they're sadly far too commonplace in the political arena -- but they're certainly dangerous.  And before we know it, these governors may just get off scott-free.
